Data related to an order
When you purchase the album, your name and email address are collected
via our payment provider Payhip (subject to its own privacy policy).
This information is used only to process your order, deliver the album
and issue your invoice. It is never sold or used for marketing.
Data appearing on invoices is kept for 10 years,
in accordance with legal accounting obligations.
Under the GDPR, you may request access to and rectification of your data
at contact@anaislaharpiste.com;
deletion of invoicing-related information before that period is not possible.
Terms and Conditions of Sale
Article 1 – Purpose
These terms and conditions define the terms
governing the musical services provided,
as well as the sale of the digital album “Bonjour Bons Jours”,
by the micro-business Anaïs La Harpiste.
For musical services, signing a quotation implies unconditional
acceptance of these terms and conditions. For the purchase of the
digital album, confirming the order constitutes acceptance of
these terms and conditions.
Article 2 – Booking Validation
A booking is considered confirmed
upon receipt of the dated and signed quotation
by the client.
Signing the quotation constitutes
a firm reservation of the performance date.
Article 3 – Performance of Services
The performer agrees to provide the musical service
with professionalism and to the best possible standard.
The client agrees to provide all necessary information
for the smooth running of the performance
(venue, schedule, access, hosting conditions).
The performer agrees to comply with
the venue’s internal rules and safety instructions.
Article 4 – Cancellation
Cancellation by the client:
- more than 30 days before the performance: no charge
- between 30 and 7 days before the performance: 50% of the total amount remains due
- less than 7 days before the performance: 100% of the total amount remains due
These fees compensate for the reservation of the date
and the inability of the performer
to accept other engagements.
Cancellation by the performer:
In the event of force majeure (see Article 8),
a new date may be proposed whenever possible.
Article 5 – Prices
Prices are indicated in euros.
Anaïs La Harpiste operates under the French micro-business regime:
VAT not applicable, art. L. 233-3 of the French CIBS.
Travel expenses are specified in the quotation.
Article 6 – Payment Terms
For musical services, payment may be made by bank transfer or cheque.
Invoices are payable upon receipt
and no later than 45 days
from the invoice issue date.
Payment terms for the digital album are set out
in the “Sale of the digital album” section below.
Article 7 – Late Payment
In the event of late payment,
penalties will apply at the legal rate in force,
together with a fixed compensation fee of €40
for recovery costs,
in accordance with French law.
In the event of unpaid invoices relating to previous services, the provider reserves the right to suspend or postpone any new service, including where a quotation has already been signed, until all outstanding amounts have been paid in full.
Article 8 – Force Majeure
The performer cannot be held liable
for failure to provide the service
in cases of force majeure as defined
by article 1218 of the French Civil Code,
including: unforeseen family events, illness,
accident, hospitalization, loss of voice,
or any event beyond her control
preventing the performance from taking place.
In such cases:
- the client will be informed as soon as possible
- a new date may be proposed
If rescheduling is not possible,
the performance will be cancelled
without compensation for either party.
Article 9 – Disputes
These terms and conditions
are governed by French law.
In the event of a dispute,
an amicable solution will be sought first.
Failing agreement,
the dispute may be brought before
the Commercial Court of Bordeaux.
Sale of the digital album “Bonjour Bons Jours”
Purpose: sale of an album in digital format, to download.
Price: from €15 (pay what you want), in euros.
VAT not applicable, art. L. 233-3 of the French CIBS.
Payment: online by credit or debit card, via the payment
provider Payhip (securely processed by Stripe).
Delivery: after payment, a download link for the album
(audio files, lyrics and chords) is provided.
An invoice is available on request.
Right of withdrawal: in accordance with article L221-28
of the French Consumer Code, the right of withdrawal does not apply to
digital content supplied immediately. By purchasing and downloading the
album, the customer expressly requests immediate performance and
acknowledges waiving their 14-day right of withdrawal.
